Abstract
With respect to intercollegiate athletics, Title IX applies to three broad areas: financial assistance to athletes; "other program areas" such as "treatment, benefits, and opportunities" for athletes; and "equal opportunity". Institutions could employ a variety of strategies to improve compliance with the substantial proportionality test. They could "equalize up" by simply increasing the number of female athletes, keeping the number of male athletes the same, to the point of substantial proportionality. Most notorious are the cases of men's wrestling and gymnastics, which have seen substantial decreases in the number of teams and participants over the 1980s and 1990s. Therefore, it is important to disaggregate the total figures reported above into figures presented separately by sport. Athletic departments differ in terms of Title IX compliance as well as changes over time in male and female athletics. Football roster sizes are enormous relative to other sports.
