Obscenity, sexting, and cyberbullying

The rise of the Internet brought about new challenges in the regulation of undesirable sexually explicit content in the United States. At the core of these challenges is our nation's fundamental belief in the protection of expression under the First Amendment. Increased use of electronic communication devices and social media, however, transformed these challenges into everyday concerns for employers, parents, and communicators-looking to limit the exchange and receipt of sexual photos, text messages, and other content. This chapter examines the legal implications of instantaneous communicationin this context, including cyberbullying, sexting, and exchange of indecent and obscene images and text.
