Abstract

AI in clinical medicine raises hopes, but at the same time also poses privacy concerns due to its reliance on Big Data. This chapter will explore privacy laws in different jurisdictions, namely the USA, Europe, and South Africa. It will discuss the US Health Insurance, Portability, and Accountability Act of 1996 (HIPAA) and recent legal developments at state level in the USA, as well as the European Union General Data Protection Regulation (GDPR) and South Africa's Protection of Personal Information Act (POPI Act). The chapter will also include an analysis of some of the similarities and differences between these privacy laws.
